Kinder Morgan Canada is seeking a Contract Specialist for the Trans Mountain Pipeline Expansion Project (TMEP). In operation since 1953, the Trans Mountain Pipeline spans 1,150 kilometers from Edmonton, Alberta to Burnaby, British Columbia with a capacity of the 300,000 barrels per day. Kinder Morgan Canada recently affirmed the Final Investment Decision and announced its plans to proceed with its proposed expansion of the existing Trans Mountain Pipeline system. TMEP is approximately a $7.4B project to increase the capacity of the Trans Mountain Pipeline System by completing the twinning of the existing pipeline.

There is an opportunity for an experienced Contract Management professional with major capital project planning & execution expertise to join TMEP SCM Project Team and to contribute to the execution phase of the Trans Mountain Expansion Project.

Reporting to an Area SCM Manager, the Contract Specialist is responsible for planning, implementing and administration of major contract awards, from developing the contracting plan, managing the contract management life cycle, mitigating risks to awarding contracts, claim management and contract closeout. Support developing project supply chain strategies, work collaboratively with project teams to obtain approval, and implement resulting strategies and plans.

Contract Specialist will be responsible for the developing contract plan, contract preparation, award and administration of EPC/ EPCM; Construction, Supply and/or Service contracts for major projects. This will involve:

  • Coordinating with other departments within the Project Team to develop the format and scope of contracts;
  • Anticipating and assessing supply chain risks and project impacts, and developing and recommending solutions;
  • Drafting RFP/RFQ documents starting with standard templates and tailoring as required to execute the approved strategies and contracting plans; leading and facilitating evaluation teams and negotiations with suppliers and contractors, as required;
  • Providing expert input and leadership in the preparation and/or editing of contract documents (including the basis of payment for work) and ensuring that the engineering, commercial, legal and other requirements are properly and accurately described in the contract documents;
  • For direct awards, overseeing the development of, and undertaking and/or leading vendor evaluation criteria, evaluation weightings, and performance indicators to ensure that the most suitable contractor is selected;
  • Leading debriefing sessions with unsuccessful respondents to maintain ongoing relationships;
  • During EPC/ EPCM Contract execution phase, overseeing subcontract procurement life cycle (tier 2) (review award recommendations; aboriginal reports; closeout reports; subcontract payments as part of rules of credit/ milestone payments);
  • Reviews and manages contractual obligations of the parties and provides continual review to ensure that all terms and conditions are met;
  • Responsible for consultation and escalation to Area SCM Manager and Project SCM Director, of contractual positioning issues which are not solved satisfactorily by the project team in a timely manner
  • Responsible for informing the project team of the requirements of the contract and monitoring compliance
  • Prepares and disseminates information regarding contract status, compliance, modifications, etc.
  • Acts as the primary contact between the project team and/or business unit and Legal, ensuring that all legal and contractual matters are addressed efficiently and promptly
  • Responsible for assigned Contract Management, project or business personnel adhering to company policies and procedures.
  • Participate in Contract Audits, as required.

 

Position Requirements

  • An undergraduate degree in an engineering; legal or business-related subject with focus on Supply Chain Management. Prior completion of specialized procurement or business administration training, preferably SCMP or NCMA
  • 15+ years’ of industry (Oil & Gas; Pipeline) experience in the contact formation, award and management. Industry experience must include experience in major project environment and have managed EPC/ EPCM and major Construction type contracts, and the role encompass: the development of procurement/contracting strategies, including determining the optimal risk allocation & incentive schemes; compensation methods; the preparation of procurement and contract documents; supporting contractor/supplier negotiations; and determining strategies to manage technical and commercial risks.
  • Extensive knowledge of contract law and experience in contract negotiation and administration; claim management.
  • Experience working in a business environment that is complex, with multiple stakeholders and strategic considerations.
  • Excellent writing and communicating skills.
  • Ability to multi-task and simultaneously manage multiple complex/large projects with deadlines and deliverables.
  • Strong negotiator with proven ability to lead through influence, utilize business acumen to determine best course of action and tradeoffs, and resolve conflicts.
  • Highly skilled in change management and must have excellent interpersonal, communication, team building and persuasive influencing skills.
  • Strong analysis, risk assessment and business strategy skills to lead cross functional teams through complex business issues.
  • Proactive, adaptable to changing needs, strategic thinker.
  • Must be able to prioritize and manage the work load with minimal supervision
